Our services involve marketing to prospective patients (who are not yet under your care and whose information is not subject to HIPAA). Once someone becomes your patient, you assume full responsibility for HIPAA compliance regarding their information.

Maximum Liability Cap

Shortened Claims Period
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our services or these disclaimers must be filed within ONE (1) YEAR after such claim or cause of action arose, or such claim or cause of action shall be permanently barred.
For clarity, the one-year period begins to run when you first knew or reasonably should have known of the facts giving rise to the claim, but in no event later than termination of services.

You and Patient Solutions LLC expressly waive any right to a trial by jury in any action, proceeding, or counterclaim, whether in contract, tort, or otherwise, arising out of or relating to these disclaimers or your use of our services.
Unless both you and Patient Solutions LLC agree otherwise in writing, the arbitrator (or court if arbitration does not apply) may not consolidate or join the claims of multiple persons or parties, and may not otherwise preside over any form of a consolidated, representative, or class proceeding. The arbitrator (or court) may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
